District Court Dismisses Freelancer Lawsuit Against SWACCA-Supported Independent Contractor Rule

Yesterday, a federal judge in the Middle District of Tennessee dismissed a lawsuit two freelancers filed in February 2024 against the Department of Labor’s SWACCA-supported independent contractor rule that took effect in March 2024 and makes it harder for employers to label their workers as independent contractors. The judge held that the freelancers failed to establish Article III standing to challenge the rule because they “failed to demonstrate” that they “will suffer an actual or imminent injury related to the 2024 Rule.”
