Today, the U.S. Court of Appeals for the Fifth Circuit ruled that the Deferred Action for Childhood Arrivals (DACA) is unlawful, despite recent Biden Administration regulations to codify the program. Notably, the appellate court rejected the nationwide injunction ordered by the lower court and geographically limited the injunction to cover the state of Texas. Additionally, a stay for DACA recipients enrolled prior to the district court’s injunction remains in place.
