The Trump Administration filed an appeal to the U.S. Supreme Court urging the justices to undertake an expedited review of last Friday’s ruling from the U.S. Court of Appeals for the Federal Circuit striking down tariffs issued pursuant to the International Emergency Economic Powers Act (IEEPA). This includes the IEEPA-based “reciprocal” tariffs imposed by the Trump Administration in April, as well as the as well as a separate set of tariffs imposed in February against China, Canada, and Mexico. The Federal Circuit’s decision did not impact tariffs used under other legal authorities, such as the tariffs on steel and aluminum imports.
The petition to the Supreme Court states that these tariffs “are promoting peace and unprecedented economic prosperity, and that the denial of tariff authority would expose our nation to trade retaliation without effective defenses and thrust America back to the brink of economic catastrophe.” The White House wants the Supreme Court to decide by September 10th if it will review the case.
