The Small Business Administration Office of Advocacy submitted comments to the Justice Department and the Federal Trade Commission in response to their Requests for Information inviting public comments identifying laws and regulations that raise barriers to, or otherwise harm, competition in the American economy.
Among the regulations the Office of Advocacy identifies as barriers to competition that should be revised or rescinded are: (1) FAR Council Regulations implementing President Biden’s Executive Order on Project Labor Agreements because of their alleged “impact on small construction contractors and the number of bidders on a project”; (2) the Wage and Hour Division’s final rule updating Davis-Bacon prevailing wage regulations; (3) the Occupational Safety and Health Administration’s proposed rule on Heat Injury and Illness Prevention in Indoor and Outdoor Work Settings; (4) the Wage and Hour Division’s Overtime Rule increasing the required minimum salary level to be exempt from overtime and minimum wage requirements under the FLSA; and (5) the Federal Trade Commission’s final rule banning non-compete agreements.
