Today, the Occupational Safety and Health Administration (OSHA) published a final rule without opportunity for public notice and comment ending its longstanding practice of consulting with the Advisory Committee on Construction Safety and Health (ACCSH) in the formulation of safety rules applicable to construction. OSHA says it is not statutorily required to consult the ACCSH on all such rules and its practice of doing so “unduly inhibits” OSHA “from moving forward expeditiously with priorities.” The final rule also reduces membership on ACCSH from 15 members to the statutorily required nine members.
This final rule is effective today, July 1, 2025.
