District Court Pauses Lawsuit Against Biden-Era Final Rule Implementing Mental Health Parity and Addiction Equity Act

The U.S. District Court for Washington, D.C. paused the ERISA Industry Committee’s lawsuit over the Biden-era final rule implementing the Mental Health Parity and Addiction Equity Act (MHPAEA). The 2008 MHPAEA requires insurers and corporate-backed health plans, which cover more than 175 million Americans, to provide access and payment structures for mental health care services on par with other medical services. The Trump Justice Department requested the pause, saying that the Trump Departments of Health and Human Services, Treasury, and Labor are reconsidering the rule. The Trump Administration also said that it plans to issue a partial “non-enforcement policy” in the meantime, and to “reexamine the Departments’ current MHPAEA enforcement program more broadly.”
