DHS Sends Final Rule Shielding Undocumented Spouses of U.S. Citizens from Deportation for White House Review as Arrests Plummet at Southern Border

The Department of Homeland Security (DHS) submitted for review to the White House Office of Information and Regulatory Affairs (OIRA) a final rule entitled, “Implementation of a Parole in Place Process for Certain Noncitizen Spouses and Stepchildren of U.S. Citizens.” Back in June, the Biden Administration announced new executive actions to protect undocumented spouses of U.S. citizens from deportation, allow them to work legally in the country, and provide a more streamlined pathway to U.S. citizenship. OIRA review is typically the final step before an item is published in the Federal Register.

The final rule comes as Biden Administration officials said that United States-Mexico border arrests have plummeted about 30% in July to a new low during the Biden Administration. The reduction in arrests raises the prospects that a temporary ban on asylum implemented in June may soon be lifted.
