DHS Asks Supreme Court to Block Order Requiring Government to Give Migrants Opportunity to Object Before Being Deported to a Third Country

The Department of Homeland Security (DHS) asked the Supreme Court to block a Massachusetts District Court’s ruling requiring the government to give people notice and an opportunity to object before they are deported to a “third country” (i.e., a country that is not an immigrant’s home country or an alternative country ordered by an immigration judge).

The case at hand was initiated in response to the Trump DHS’s March 2025 guidance establishing that if a third country has given credible diplomatic assurance that it will not persecute or torture migrants, individuals may be deported there “without the need for further procedures.” The District Court’s preliminary injunction was upheld by the First Circuit Court of Appeals.
