As a follow up on last month’s Federal Court of Claims decision upholding several bid protests of large scale federal construction contracts with project labor agreement (PLA) clauses pursuant to former President Biden’s PLA executive order and Federal Acquisition Regulatory (FAR) Council Rule 22.505, the Office of the U.S. Defense Department (DOD) Undersecretary for Acquisition has directed all DOD contracting officers to “immediately” cease using “project labor agreements for large scale construction contracts.” This applies to both existing and future contracts.
