House Science Subcommittee Examines Permitting and Grid Capacity to Support AI Data Center Growth

The House Science Subcommittee on Investigations and Oversight held a hearing entitled, “Powering America’s AI Future: Assessing Policy Options to Increase Data Center Infrastructure,” examining whether federal permitting, grid capacity, and regulatory frameworks can keep pace with surging electricity demand driven by AI and large-scale data center development.

During the hearing, Republicans emphasized that data centers are foundational to winning the AI competition battle with China and argued that lengthy permitting timelines under NEPA, the Clean Water Act, and other statutes, along with litigation and ineffective federal backstop authority, are delaying transmission lines, power plants, and related infrastructure critical to national security and economic growth. Lawmakers also highlighted bipartisan transmission reform efforts such as the SPEED Act as a step toward accelerating grid expansion. Democrats acknowledged the economic importance of AI but warned that rapid data center expansion could strain electric grids, raise residential electricity costs, increase water consumption and pollution, and burden host communities without stronger transparency and guardrails.

Paige Lambermont of the Competitive Enterprise Institute attributed rising power scarcity to policy-driven plant retirements and urged broad-based permitting reform, including changes to environmental statutes and expanded options for off-grid “consumer regulated electricity” models. Marsden Hanna of Google stressed that transmission congestion and fragmented permitting threaten U.S. competitiveness, endorsed expanded federal transmission authority and streamlined reviews, and highlighted Google’s multi-billion-dollar data center investments across several states. Dr. Eric Masanet of the University of California, Santa Barbara focused on the lack of standardized, timely public data on data center energy and water use, arguing that improved reporting, federal data collection, and greater transparency are essential for accurately assessing infrastructure needs and community impacts.
