The U.S. Fifth Circuit Court of Appeals in Mayfield v. U.S. Department of Labor upheld the authority of the U.S Department of Labor (DOL) to include a salary basis in the test defining overtime exemptions for executive, administrative, or professional employees under the Fair Labor Standards Act. In its ruling, the court said that the overtime exemptions “fell within the [DOL’s] explicitly delegated authority to define and delimit the terms of the exemption.”
