Federal Judge Blocks Trump Executive Order Seeking to End Birthright Citizenship

A federal judge in New Hampshire appointed by President George W. Bush issued a nationwide injunction blocking President Trump’s January 20, 2025 executive order seeking to end birthright citizenship. The judge was able to issue a nationwide injunction despite the recent Supreme Court ruling curtailing the power federal court judges to do so because the case involves a nationwide class of plaintiffs. Notably, the judge said the preliminary injunction “is just not a close call to the court,” explaining that the “deprivation of U.S. citizenship and an abrupt change of policy that was longstanding” definitely constitutes “irreparable harm” warranting an injunction.
