The Environmental Protection Agency (EPA) seeks comments on its draft 2027 National Pollutant Discharge Elimination System (NPDES) Construction General Permit, which would govern stormwater discharges from construction activities in areas where EPA serves as the permitting authority. The permit applies to construction projects that disturb one or more acres and establishes requirements for erosion and sediment control, pollution prevention, and site stabilization. The draft includes several changes intended to streamline permitting and compliance, including revisions to reflect the Supreme Court’s decision in City and County of San Francisco v. EPA, more specific permit requirements in place of broader water quality standards, and reduced documentation requirements for certain projects.
Comments are due September 2, 2026, through the federal eRulemaking Portal using Docket ID EPA-HQ-OW-2025-0760. EPA will also host a related webinar on August 18, 2026 from 2pm to 3:30pm ET. Those interested in participating, including by providing oral comments, must register here in advance.
