EBSA Announces FY2026 Enforcement Priorities

The Employee Benefits Security Administration (EBSA) announced a major overhaul of its FY 2026 national enforcement projects, shifting investigative priorities to focus on higher impact compliance issues affecting workplace health and retirement plans. Under the updated approach, EBSA said it will emphasize investigation tied to barriers to mental health and substance use disorder benefits, protecting benefit distributions, retirement asset management, surprise billing, cybersecurity, and criminal abuse of contributory benefit plans, while continuing its work against fraudulent multiple employer welfare arrangements (MEWAs). EBSA also removed Employee Stock Ownership Plans from the national project list and said it will reduce its focus on missing participants following creation of the Retirement Savings Lost and Found Database.
