The Departments of Labor, Health and Human Services, and Treasury issued a notice announcing the departments will not enforce or otherwise pursue enforcement actions under the Biden-era Mental Health Parity and Addiction Equity Act (MHPAEA) final rule. The Departments requested in a Tuesday filing with a District Court in Washington, D.C. that a lawsuit filed by the ERISA Industry Committee challenging provisions of the 2024 MHPAEA final rule be held in abeyance while the Departments “reconsider the final rule, including whether to issue a notice of proposed rulemaking rescinding or modifying the regulation.”
